Renting in Phuket: what to check before paying a deposit
“Three other people want this villa.” Quite possibly. But those three strangers are not obliged to pay for your future problems. You should not have to acquire that obligation either.

Before paying, check the property, the recipient’s authority, the lease, building rules and the home’s condition. Put deposits, charges, repairs and departure arrangements in writing. Legal restrictions depend on the landlord and the type of agreement.
Start by establishing who you are paying
A link to an attractive listing proves that an attractive listing exists. It does not prove the right to let the property. Ask for the exact address, unit number, evidence of the owner’s or representative’s authority and the recipient’s payment details. If an agent signs, establish whose behalf they are acting on.
For a remote viewing, request a continuous video showing the entrance, window views, rooms, bathrooms and appliances. For a substantial commitment, an independent inspection by someone on the ground is sensible. Urgency does not replace verification; sometimes it explains exactly why verification matters.
Understand which rental rules apply
The B.E. 2568 (2025) rules cover certain landlords letting three or more residential units; hotels and dormitories are excluded from this category. Do not stop at “everything works”. Record scratches, chips and stains before taking the keys. Otherwise an old scratch can suddenly acquire a new author at checkout: you.
Count the full cost of the agreement
Ask the lease to specify who pays for cleaning, pool maintenance, gardening, internet, air-conditioning repairs and utilities. If the listing says “all included”, find out whether “all” survives the first electricity bill.
A sensitivity example: assumed consumption of 600 kWh with a tariff difference of 3 baht creates a monthly difference of 1,800 baht. This is a calculation, not a current tariff. Agree how to leave before moving in
- Specify how and when to give notice.
- Record the grounds for deductions and how damage must be evidenced.
- Confirm the deposit return deadline and bank charges.
- Agree on a joint inspection when handing back the keys.
- Keep the lease, receipts, photographs and correspondence in one folder.

A good contract helps the same agreement mean the same thing in two languages, and six months later.

Frequently asked questions
Are Phuket deposits always limited to three months?
No. The rule applies to particular controlled agreements and counts the deposit together with advance rent. Check the landlord category, lease duration and applicability.
Can I pay before viewing in person?
It increases the risk. At minimum, verify authority, the property, the agreement and payment details. An independent on-site inspection is useful for a substantial rental commitment.
